Procedure for the exercise of ARCO Rights

The current legislation on data protection, recognizes citizens the rights of access, rectification, cancellation and opposition to their personal data.

To facilitate the exercise of these rights, we provide you with the necessary information, as well as the different forms to exercise them free of charge.

ARCO RIGHTS

1 What is the right to Portability?

It is the right of the interested party to transfer, copy or transmit personal data from one computer environment to another.

Does portability entail deletion of data?

No. Portability does not mean automatic data deletion.

What data should be included?

  • The personal data of the interested party.
  • The data that has been provided to the person responsible for the treatment.
  • The data provided in the development of the activity and the use of the service.
2What is the right to erasure?

It is the right of the affected party to have the data that turns out to be inappropriate or excessive be deleted.

Does the affected person need to justify it?

Yes, the data to be canceled and the cause that justifies it must be indicated, providing documentation.

How long do I have to reply to the affected person?

You must resolve on the request for deletion within a maximum period of one month.

When do I have to make the right effective?

The deletion must be made effective immediately after the reply to the affected party, if this is affirmative.

3 What is the right of limitation?

The right to the limitation of personal data establishes a right for the data to be marked in such a way that a treatment in the future is avoided by the person in charge.

Does the affected person need to justify it?

Yes, the affected party must indicate the concurrence of well-founded and legitimate reasons related to her specific personal situation.

In what situations can there be a limitation to the treatment?

  • Challenge of data accuracy, during the period that the controller is allowed to verify it
  • Illicit treatments in which the interested party opposes the deletion
  • The data is no longer necessary for the purpose of the treatment, but the interested party needs it for the formulation, exercise or defense of claims

How long do I have to reply to the affected person?

You must resolve on the limitation request within a maximum period of one month.

When do I have to make the right effective?

It must be made effective immediately after the reply to the affected party, if this is affirmative.
